Our Terms & Conditions are applicable for all photography bookings. Prior to your session with Lizzie Findlater Photography, this contract/these terms are to be read and agreed to prior to your session with Lizzie Findlater Photography. If you are unsure of anything, or would like further information about these terms, please feel free to contact us. We reserve the right to change these Terms & Conditions at any time.
Session Fees: The session covers the photographer time and talent only and does not include any packages, prints or products unless specified in writing by Lizzie Findlater Photography.
We reserve the right to adjust prices at any time without prior notice however original prices will be honoured for those who have already booked.
Cancellation: Session fees are non refundable. In the unlikely event that the photographer has to cancel the appointment, an alternative date will be offered where possible. If the alternative date is not suitable, the Photographer will provide a full refund. The Photographer completely understands that illnesses can develop suddenly, so I ask for at least 24hours notice if you or your children are sick. An alternative date will then be offered, but if the booking is cancelled within 24 hours or there is a no show, a re-booking fee will apply. Late arrivals will be charged the full price for their shoot but cannot unfortunately be guaranteed a full shoot time.
Price of Products: Session fees do not include any images. Please look through the package pricing when booking with Lizzie Findlater Photography.
Session Details: The Photographer will end the session at their discretion when it is determined that adequate images in terms of quality and quantity have been captured. The Photographer will make every effort to comply with requests for specific photos. Please ensure these are notified in advance of the sitting. Requests that are felt to be unsafe will be refused. It may not be possible for all of the images requested, or those expected, to be captured. Natural environment sessions may be rescheduled due to rain with the recommendation of the photographer, but not overcast weather. The photographer cannot be held responsible for photographs which could not be captured due to lateness or willingness of subjects.
During the session: It is not permitted for the Client or any other connected party to take his or her own photographs, be it on a tablet, phone or camera. This includes location shoots, mini shoots, and studio shoots whether they are paid or promotional shoots.
Proof Galleries: The edited images will be viewable in a private viewing appointment approximately 2-3 weeks after the shoot for the client to choose their photos. If the client is unable to attend appointment due to distance (minimum 40 miles), the images will be added on to an online gallery for viewing. This gallery contains low quality images. These images must not be copied, screen shot, downloaded, edited, used on social media, or altered in any way. The proofs are small JPEG files, and their only purpose is for the proof gallery - the final images are processed from high quality RAW files. The gallery will be active for 2 days (date of gallery opening will be agreed with client). Clients must review their images and choose their digital images/prints within these 2 days. Any complimentary print credit will expire after these 2 days if orders are not placed within this timeframe. Should the client require the gallery to be re-opened after these two days, there will be a £25 charge to do so. The digital files of all images purchased will be archived. Client should make a backup of USB contents on receipt in case of any unforeseen corruption/damage to USB. If anything is wrong with the USB the client must let Lizzie Findlater photography know within 5 days of receiving the USB. If USB is damaged/lost and client requires another copy of the contents on USB, this will be an additional cost.
Copyright, Ownership & Reproduction: © Lizzie Findlater Photography 2023. The copyright and all other rights in the photos shall be retained by Lizzie Findlater, "the photographer" at all times throughout the world.
No image can be copied, scanned or reproduced in anyway with the written consent of the photographer. The client may not alter, edit or manipulate by any means without written permission from Lizzie Findlater Photography.
The Photographer asserts the right to be credited as the author of the Photos in accordance with sections 77 and 78 of Copyright, Designs and Patents Act 1988. Any unauthorised reproduction of any Photos will constitute a breach of copyright. All watermarked or unpurchased images displayed on Lizzie Findlater Photography Facebook may be 'Shared', or tagged however please don't remove any of the original post tags/links. You may use images for social profiles but please leave the Lizzie Findlater Photography watermark visible. These images are low resolution proofs without permission to download, print, save or change. All rights reserved.
Permission to reproduce an image for personal use (not commercial) is granted to the client from Lizzie Findlater Photography, only when digital images are purchased and paid in full by the client to Lizzie Findlater Photography.
Force Majeure: In the unlikely event of total photographic failure, injury or sickness beyond the Photographer’s control, our liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected. Lizzie Findlater Photography holds full Public Liability Insurance.
Use of Pictures: Lizzie Findlater Photography retains the right in all cases to use the pictures in displays, advertising, portfolio, publications and promotion of her work. I will always ask the client if they are happy for me to use on social media. Model calls and free sessions are used on social media and if a clients wishes for them to not be on social media, they forfeit the free session and all session fees and images will have to be paid for in full.
Data Protection: Lizzie Findlater Photography will store Client names, contact details and session information privately and will not share these with any other business or organisation.
